 1. How the Navy, the media and the president handled this case, and other recent military cases, warrants review.

Please consider the following and answer support your position with detail for maximum points:

A. Please list all criminal charges against Eddie Gallagher.

B. Eddie Gallagher claimed there was no intention to save the ISIS fighter; rather the emergency medical treatment, including cutting an emergency airway in the ISIS fighter’s throat and inserted a breathing tube "just for practice." Some professionals argue that emergency medical practice treatments are common place on the battlefield in order to provide military professionals the necessary ability to potentially save lives and/or improve skill sets. They argue it is critical not to quarterback or critique decisions made in the heat of battle. Others argue this violates the Geneva Convention, which states under Article 32 of the 1949 Geneva Convention IV that, “mutilation and medical or scientific experiments not necessitated by the medical treatment of a protected person” are prohibited. The Navy declined to investigate or pursue charges against Eddie Gallagher for his alleged actions regarding medical treatment of the ISIS fighter. Do you agree with this decision? What level of scrutiny do you think should be directed towards military personnel on the battlefield?

C. The judge removed the lead prosecutor in the case against Gallagher one week before the trial began. Why? What misconduct did the prosecution engage in? What type of consequences should be levied against prosecutors that engage in misconduct?

D. Chief Petty Officer Gallagher was entitled to a fair trial. Republicans in Congress rallied in support of Gallagher, saying he had been mistreated. President Trump, who intervened to move Gallagher to better confinement, considered dismissing the charges and later gave him a pardon. Do you believe Gallagher was mistreated? Do you think his eight tours of duty, six as an elite special forces operator serving on the front lines of combat, should be taken into consideration or was the murder charge appropriate?

E. A jury of Eddie Gallagher’s peers, military professionals, acquitted Eddie Gallagher of all serious criminal charges with the exception of posing with a corpse. Do you agree with the verdict? Why or why not?

F. Should Eddie Gallagher have been allowed to keep his Navy Seal Trident? Why or why not?
