Topic Description

My Capstone Project topic is “Women’s Liberation from Violence and the Court System’s Gender Bias Which Further Victimizes Survivors.” This topic addresses gender-based violence and how women survivors of rape and sexual assault are further violated by the justice system. To the current date, as observed by Carroll (2022), there has not been any transformation to the criminal justice system to safeguard sexually violated women. Consequently, survivors undergo not only the violation during the assault but also re-victimization by the legal systems, where they might face disbelief, victim blaming, and lenient treatment of the offenders. This topic is to raise awareness of what women go through when searching for justice and help and how the system should be reformed for survivors. To achieve this, this issue seeks to evaluate prejudicial beliefs among judges and determine how female victims can evade such attacks.

Specific Problem Description

The specific issue connected to my topic is the gender bias in the court system that re-victimizes women who were sexually assaulted. This bias is illustrated by not giving credence to victims, rationalizing offenders, and shifting blame to the victim in court. Such considerations prevent the delivery of justice to the victims and encourage perpetrators to go scot-free. Research shows that police and judicial employees do not believe GBV victims, particularly sexual violence victims, and have negative attitudes towards them, leaving them reluctant to report their cases and compounded by trauma (Sherman et al., 2023). It perpetuates injustice in the justice system and fails to provide the necessary assistance to victims. Addressing this problem involves conducting research on court gender bias and identifying ways to ensure fairness for all sexual abuse victims. This research aims to identify ways to minimize bias and enhance outcomes for female survivors in their quest for justice.
