The Signature Assignment will focus on an evaluation of
constitutional principles in the context of the business sector and the development of recommendations to provide to your leadership in relation to a business practice that aligns with the constitutional and federal law.
Consider the industry and hypothetical business that you have chosen during the course. This is the same company that you have used during the assignments in the course. As a legal assistant, you are asked to assist the corporate attorney in developing a white paper that explains the relevance of constitutional principles to the specific industry and your company. You will also detail recommendations for your leadership regarding potential implementations to facilitate company alignment with these constitutional principles.
In the white paper, you will:
• Explain the roles of the executive, judicial, and legislative branches in the specific industry and your company.
• Explain the relevance of judicial review in your chosen industry and your company.
• Explain the relevance of the First and Fourteenth Amendments in your chosen industry and company.
• Analyze the impact of the Commerce Clause and Supremacy Clause on your industry and your company.
• Analyze the impact that federal laws have on your industry and your company.
• Develop and recommend strategies to help the company to become aligned with constitutional principles and federal law.
Although it can be assumed that a functioning company has implemented many components to align itself with the U.S. Constitution and federal law, assume that you have a blank slate. Your recommendations can be proposals to continue a certain policy or guideline or can be suggestions for implementation. Your goal is to ensure that your company has as much information as possible concerning the industry and the hypothetical company. For example, you may recommend a review of accounting practices and a multi-tiered system for financial reporting. The paper will discuss this practice and offe an academic foundation for the practice. Additionally, the paper may recommend this implementation, and then explain why this would be optimal. This analysis would also discuss potential consequences to such an implementation.
