You are attending your Family Fourth of July BBQ and each of the following family members starts to talk about their legal problems.
Your Grandma is extremely upset that the well-known contractor she hired to paint her house, refuses to finish the job and she wants to start a lawsuit against him. The contractor has offered to give her $200 for her troubles but Grandma is determined. She wants the contractor to finish the job because she wants to upstage her rival, Mary Alice across the street.
Your Cousin Larry is a 5th year college student, trying to find his way through life. Larry is being sued by Citibank for maxing out his credit card. He just received his first notice about the lawsuit in the mail and the notice states he needs to do something in 20 days. Larry says he really doesn’t have time to deal with this. He laughs and says, “Hey, I’m a college kid. They know I’m broke. What’s the worse thatcan happen if I just ignore it? Nothing!”
On the other end of the table, you have Aunt Mary and Aunt Jenny. Aunt Mary is being sued by Aunt Jenny. Jenny allowed Mary to use her home to host a Mary Kay Make-up Party. Jenny said that Mary allowed her rowdy friends to trash her house and cause extensive damage to it. However, Aunt Mary says not only is that not true, Jenny is really at fault because Jenny stole all of the left over Mary Kay makeup without paying for it that day. Mary said Jenny is the one who is really wrong and she wants to sue Jenny right back.
Lastly, your cousin Mike is being sued by his condo association for breach of contract but he is angry that the condo association didn’t include his roommate, Jeff in the lawsuit because Jeff is just as liable as Mike is, they just left Jeff out the lawsuit.
While you cannot offer any of them legal advice (you will learn why when you take the Ethics course), you decide this is a great opportunity to test your legal skills. So while eating your apple pie, you ponder the following questions:
4a. What does Grandma need to file withthe court? Based upon the facts, what form of relief would Grandma be seeking?
4b. What does Cousin Larry need to file with the court? What could potentially happen of Larry does not file this with the court?
4c. What can Aunt Mary file in response to Aunt Jenny’s lawsuit?
4d. What can Cousin Mike file in response to the condo association’s lawsuit to bring his roommate into the lawsuit?
