sara  works as a doll maker from her home and she  has one son age 8.

Most of sara’s  business  comes by word of mouth referrals,but  she  does have a business  name softest  stuffies  a website  and good  reviews  on google. 

Deep hamza   found a online through  Google  reviews. 

Deep is  blessed  to be a grandmother  of twelve  grand  children  ages(1-11)  and looking  for special  gift to give the children. she wanted. she wanted  to a gift that was unique and it was a home made.but she was very crafty person.Sara Pratt’s homemade  cashmere  fabric  dolls  and teddy  bears seemed  rather  expensive  but they looked beautiful  and well made.Deep does love the finer things in life and believes that one should  spend their money on beautiful  things that bring joy .it doesn’t  hurt that deep has recently  retired  from  her successful  real estate  practice  she now has millions in the bank.

Deep and sara communicated by zoom video conference  call on April  13 ,2022, and they discussed  Deepa s request  regarding  the home made dolls and teddy bears .Deepa wanted  to order a cashmere  teddy  bear for each grand child. she asked  sara to make four light brown  teddy bears; six green teddy bears; and two blue teddy bears.

Sara charged  $ 350.00 for each cashmere  teddy bear and an extra $75.00 for each  of the teddy bears clothing, plus 13% Hst.Sara offered  free shipping  for all her customers. no matter order amount. 

Deep tried to talk sara down  to 200.00 per teddy  bear, bear .but sara would  not agree.

Finally, sara and deepa agreed to the terms of the custom order ,they  electronically  signed  a PDF contract  between documents. Deepa sent sara a $ 950.00 deposit  using her banks email  money transfer  service. 

Over the next six weeks, sara created twelve  hand made cashmere  teddy bears; four teddy bear: each their own sequin encrusted  dress,six teddy wearning denim overall and twio teddy bears wearing   denim overall, and two teddy bears wearing  denim  overalls , and two teddy bears wearing  a soft organic  cotton pajama set.

There was a lot of back and forth with deepa over what she kept changing  her mind about the out fits)! it took a lot longer than it usually takes to see the customer  teddy bears.she also wanted to add more sequin and parl embellishments to the teddy bear dresses. 

This ,of course, resulted in several trips to the fabric  store. Nevertheless, sara knew that she agreed to a total agreed to a total cost of $5,100 ( plus 13% hst) and didn’t  i feel right charging  Deepa any more money. 

Sara finished the teddy bears on May 27 ,2022. She  care fully packed  them up and paid  the $ 42 for fedex   to priority ship them to Deepas home address on the same day.She received  confirmation  from Fed – Ex that the package  was delivered  by 5:00  pm.

Sara emailed Deepa a final invoice  for $ 4,813.00 on 27 may,2022.The invoice  stated that full payment  was due on june 27,2022, failling which ,interest would accrue 5% per  annum thereafter.

Deepa did not pay the invoice  by june 27 ,2022..Sara called her twice during that week but could leave voice mail messages  since Deepa never answered.

sara emailed Deepa on july 4, 2022 asking  for payment  ,but Deepa did not reply.

Sara has a small  business  and can  not afford to lose any money. This was large custom order, and she has already  spent most of her inventory  budget  for this quarter. she is worried. she will not be able to fufill other customers  order if she does not collect on this debtsoon.

Sara wants to sue Deepa for the balance owing of $4,813.00( $5,100+%13HST_ $ 950 deposit) plus the 5% interest owed.

She has hired you to draft to plaintiff,s claim  to be issued  in the small  court.
